THE FOLLOWING “PRIVACY POLICY” GOVERNS ZILKR’S USE OF ALL PERSONAL INFORMATION COLLECTED ABOUT INDIVIDUALS WHO ACCESS AND USE THE SITE (“YOU”, “YOUR”, “VISITOR”, OR COLLECTIVELY “VISITORS”).

III. Security.
Zilkr maintains the Site and the Content thereon, including, but not limited to any personally identifiable information you Share via the Site, in accordance with commercially reasonable industry standards to preserve the integrity and security thereof. Zilkr has implemented technical and organizational measures designed to secure such information from accidental loss and from unauthorized access, use, alteration, or disclosure. Zilkr cannot, however, ensure or warrant that third parties will never be able to defeat those measures or gain access to such Content. Perfect information security does not exist and you use the Site at your own risk.
IV. Children.
THE SITE IS NOT INTENDED FOR CHILDREN. In accordance with the Terms, by accessing and using the Site, you represent and warrant that: a. you have reached the age of majority in the legal jurisdiction from which you are accessing the Site or have the permission of your legal guardian to access the Site; b. you have the authority and capacity to enter into this the Terms and Privacy Policy. FOR THAT REASON, ZILKR DOES NOT KNOWINGLY COLLECT OR MAINTAIN PERSONALLY IDENTIFIABLE INFORMATION FROM PERSONS UNDER THIRTEEN (13) YEARS OF AGE. IF ZILKR LEARNS THAT PERSONALLY IDENTIFIABLE INFORMATION OF PERSONS LESS THAN THIRTEEN (13) YEARS OF AGE HAS BEEN COLLECTED ON OR THROUGH THE SITE, THEN WE WILL TAKE THE APPROPRIATE STEPS TO DELETE THIS INFORMATION. IF YOU ARE THE PARENT OR LEGAL GUARDIAN OF A CHILD UNDER THIRTEEN (13) YEARS OF AGE WHO HAS PROVIDED US WITH PERSONALLY IDENTIFIABLE INFORMATION, THEN PLEASE EMAIL US TO HAVE THAT INFORMATION DELETED IMMEDIATELY.

Access to and use of Linked Sites, including the information, materials, products, and services on or available through Linked Sites is solely at your own risk. Any concerns regarding Linked Sites, or any information, resources, or services therein, should be directed to the operator of the particular Linked Site.
VI. Events Outside of Ordinary Business Practices.
IN CONNECTION WITH AN EVENT OUTSIDE OF ZILKR’S ORDINARY BUSINESS PRACTICES, INCLUDING BUT NOT LIMITED TO A SALE, MERGER, CONSOLIDATION, CHANGE IN CONTROL, TRANSFER OF SUBSTANTIAL ASSETS, REORGANIZATION, OR LIQUIDATION, ZILKR RESERVES THE RIGHT TO TRANSFER, SELL, OR ASSIGN THE INFORMATION THAT WE HAVE COLLECTED. ZILKR ALSO RESERVES THE RIGHT TO DISCLOSE ANY PERSONALLY IDENTIFIABLE INFORMATION COLLECTED BY THE SITE OR ANY OTHER ZILKR IP IN THE GOOD-FAITH BELIEF THAT IT IS REQUIRED TO DO SO PURSUANT TO JUDICIAL OR OTHER GOVERNMENTAL SUBPOENAS, WARRANTS, OR ORDERS, OR TO DISCLOSE SUCH DATA TO A GOVERNMENTAL INSTITUTION THAT HAS ASSERTED ITS LAWFUL AUTHORITY TO OBTAIN THE INFORMATION. ZILKR ALSO RESERVES THE RIGHT TO DISCLOSE ANY PERSONALLY IDENTIFIABLE INFORMATION COLLECTED BY THE SITE OR ANY OTHER ZILKR IP THAT WE BELIEVE, IN GOOD FAITH, IS APPROPRIATE OR NECESSARY: TO TAKE PRECAUTIONS AGAINST LIABILITY; TO PROTECT ZILKR FROM FRAUDULENT, ABUSIVE, OR UNLAWFUL USES; TO INVESTIGATE AND DEFEND OURSELVES AGAINST THIRD-PARTY CLAIMS OR ALLEGATIONS; TO ASSIST GOVERNMENT ENFORCEMENT AGENCIES; TO PROTECT THE SECURITY OR INTEGRITY OF THE SITE OR ANY OTHER ZILKR IP; OR TO PROTECT THE RIGHTS, PROPERTY, OR PERSONAL SAFETY OF ZILKR, OUR USERS, DEVELOPERS, OPERATORS, SERVICE PARTNERS, OR OTHERS.
VII. NON-U.S. USERS.
FOR USERS VISITING THE SITE FROM THE EUROPEAN ECONOMIC AREA OR OTHER NON-U.S. TERRITORIES, PLEASE NOTE THAT ANY DATA YOU VOLUNTARILY PROVIDED US WILL BE TRANSFERRED OUTSIDE THE EUROPEAN ECONOMIC AREA OR SUCH OTHER NON-U.S. TERRITORY FOR USE BY ZILKR FOR ANY OF THE PURPOSES DESCRIBED HEREIN.
VIII. Change in Privacy Policy.
By using the Site, you are accepting the Privacy Policy and the Terms. Zilkr reserves the right, in our sole discretion, to modify, alter, or otherwise update this Privacy Policy at any time. Such modifications shall be effective immediately upon posting. You are responsible for regularly reviewing the Privacy Policy. Your continued access of or use of the Site constitutes your agreement to all such modifications.
IX. Hierarchy of Documents.
For the purposes of the Privacy Policy, in the event of a direct conflict between the provisions of the Privacy Policy, the Terms of Use, the Developer Agreement, and Provider Agreement, the provisions of the Provider Agreement, Developer Agreement, the Terms of Use, and Privacy Policy in that order of priority, will control.
X. Construction.
Any capitalized term in this Agreement shall have the meaning herein defined. Any capitalized term not herein defined, shall have the meaning given to such term in the Provider Agreement, Developer, or the Terms of Use in that order of priority. Any hyperlinked term in this Agreement shall refer to the hyperlink. Any term in this Agreement written wholly in small capitalized letter shall be deemed a legal citation to relevant statutory law or a name of a third party entity. Additionally, throughout this Agreement when context requires, capitalized terms, singular nouns, and pronouns include the plural and possessive.
XI. Notices.
All notices, requests, demands, consents, permissions, and other communications hereunder shall be in writing by email: a. to Zilkr at legal@zilkr.io b. to Visitors when posted on the Site.
